Abrego García case: The Trump administration against judge Xinis

The Trump administration is challenging federal judge Paula Xinis's ruling on the case of Abrego García, a Salvadoran immigrant wrongfully deported. The judge's order is to expedite an investigation into whether the Trump administration is facilitating García's return.

Justice Department lawyers appealed the judge's order to submit evidence regarding García's case to the Court of Appeals. They also appealed Xinis's decision requiring the Trump administration to take steps to facilitate García's return to the United States.

Department of Justice opposes the case in court

The initiative led by the Trump administration and the Department of Justice is being pursued in two different courts. This appeal not only involves judge Xinis, but also prompts García's lawyers to redouble their efforts in the case.

This appeal also orders the judge to drop investigations against the Trump administration related to the case while the appeal process continues in court. Xinis, who was appointed to the bench from the Barack Obama administration to the present, has yet to respond.

Judge Paula Xinis's Role in the case

Last week, judge Xinis expressed her interest in discovery involving statements from federal judges and limited written discovery. She said she is not satisfied with the information the Trump administration has provided regarding the steps being taken in the Kilmar Armando Abrego García case.

In a Tuesday hearing, Xinis stated that "there will be two weeks of intense discovery, and once the file is available, we will proceed from there."
